Welcome to the ExpectCare Hospice website (the “Site”). By accessing or using the Site, you agree to these Terms of Use (“Terms”). If you do not agree, do not use the Site. ExpectCare Hospice (“ExpectCare”) may update these Terms at any time by posting a revised version on the Site.

These Terms form a binding electronic agreement between you and ExpectCare.

1. Site Content

  1. The Site and its text, images, graphics, logos, audio, video, forms, publications, and other materials (collectively, “Content”) are owned by ExpectCare or its licensors and protected by applicable intellectual property laws. You may use the Site and Content only for personal, noncommercial purposes. No ownership rights are transferred to you, and all rights not expressly granted are reserved.
  2. The Site may be unavailable because of maintenance, technical issues, third-party service disruptions, or other circumstances. References to products or services do not guarantee availability. The Site is intended for use in the United States where permitted by law.
  3. Third-party materials and trademarks remain the property of their respective owners and may be used only as authorized.
  4. The Site is for general educational and informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Consult a qualified health care provider about medical concerns. In an emergency, call 911 immediately.

2. User Conduct

You may not misuse the Site or allow others to do so. Prohibited conduct includes:

  • Copy, modify, sell, license, distribute, reverse engineer, frame, scrape, or otherwise exploit the Site or Content except as expressly permitted;
  • Interfere with the Site, its servers, networks, security features, or another person’s use;
  • Upload malicious code or unlawful, infringing, abusive, deceptive, obscene, or harmful material;
  • Impersonate another person, provide false information, solicit personal information, or violate another person’s rights; or
  • Use ExpectCare’s name, logos, marks, or Content without prior written permission.

3. Permissible Use of Content

Unless otherwise stated, you may view, copy, retransmit, and print Content for personal, informational, or internal business use only, if you:

  • Use the Content only for personal, informational, or internal business purposes;
  • Do not sell, license, lease, distribute, or charge for the Content or access to it;
  • Retain all copyright, trademark, and proprietary notices; and
  • Do not alter the Content or separate graphics from accompanying text.

You may link to the Site’s home page only if the link does not frame the Site, imply endorsement, misuse ExpectCare’s marks, disparage ExpectCare, or appear on a site containing unlawful or objectionable material. ExpectCare may revoke linking permission at any time.

4. Modifications to Terms and Site

ExpectCare may revise these Terms or related policies by posting updates on the Site. Changes apply when posted. Your continued use of the Site means you accept them; otherwise, stop using the Site and Forums.

5. Access to Site

ExpectCare may modify, restrict, suspend, or terminate the Site or your access at any time, with or without notice. ExpectCare is not liable for exercising these rights, and provisions intended to survive termination will remain effective.

6. Your Privacy

ExpectCare handles information collected through the Site in accordance with its Privacy Practices, which are incorporated into these Terms. Review them before using the Site.

7. Other Sites, Content, Products and Services

The Site may link to third-party websites, products, or services (“Linked Sites”). ExpectCare does not control or endorse Linked Sites and is not responsible for their availability, content, privacy practices, transactions, or resulting loss or damage. Your use of Linked Sites is at your own risk and subject to their terms.

8. Typographical Errors

The Site may contain errors, omissions, or outdated information. ExpectCare may correct or update information at any time without notice, including after a form or request has been submitted.

9. Copyright Infringement

ExpectCare responds to valid notices of alleged copyright infringement under the Digital Millennium Copyright Act (“DMCA”). Send a written notice to the address in Section 20 that includes:

  • Your physical or electronic signature;
  • Identification of the copyrighted work and the allegedly infringing material, including information sufficient to locate it;
  • Your contact information;
  • A statement of your good-faith belief that the disputed use is unauthorized; and
  • A statement, under penalty of perjury, that the notice is accurate and that you are authorized to act for the copyright owner.

ExpectCare may remove or disable access to material it believes in good faith infringes intellectual property rights.

10. Disclaimers

The Site and all Content, information, products, and services are provided “as is,” “where is,” and “as available,” to the fullest extent permitted by law. ExpectCare disclaims all express and implied warranties, including merchantability, fitness for a particular purpose, title, noninfringement, security, and accuracy. ExpectCare does not guarantee that the Site will be uninterrupted, error-free, complete, current, secure, or suitable for your needs, or that defects will be corrected.

You use or download Content and data at your own risk and are responsible for any resulting device damage or data loss. No information obtained from ExpectCare or the Site creates a warranty not expressly stated in these Terms.

11. Limitation of Liability

To the fullest extent permitted by law, ExpectCare is not liable for indirect, incidental, special, punitive, or consequential damages—including lost profits, revenue, data, goodwill, or use—arising from the Site, Content, or related services, even if advised of the possibility. If ExpectCare is found liable, its total aggregate liability will not exceed $100. Some jurisdictions do not allow certain exclusions or limitations, so these limits may not apply to you.

12. Indemnity

You agree to indemnify, defend, and hold harmless ExpectCare and its affiliates, officers, directors, employees, agents, licensors, suppliers, and partners from claims, losses, liabilities, damages, costs, and expenses—including reasonable attorneys’ fees—arising from your use of the Site or Content, your submissions, your violation of these Terms, or your infringement of another person’s rights.

13. Limitation on Actions Brought Against ExpectCare

Any claim arising from these Terms, the Site, or the Forums must be filed within one year after it arises or be permanently barred, unless applicable law requires otherwise. A failure to enforce any provision is not a waiver.

14. Dispute Resolution

Except for claims involving ExpectCare’s intellectual property rights or Privacy Practices, disputes arising from the Site will be resolved by confidential, binding arbitration in Birmingham, Alabama, under the then-current rules of the American Arbitration Association (“AAA”). The arbitration will be conducted before three neutral arbitrators. Claims may not be joined with those of others, each party will bear its own attorneys’ fees unless law requires otherwise, and the parties will share AAA fees equally.

Arbitration means that neither party has the right to have the dispute decided in court by a judge or jury or to participate in a class, collective, or representative action. The arbitrators’ decision is final and binding, and rights available in court, including discovery and appeal, may be limited.

An arbitration award may be enforced by any court with jurisdiction. The parties consent to Alabama state courts and federal courts in Alabama for actions to compel arbitration, enforce an award, or seek temporary relief before arbitrators are appointed. If this section is unenforceable, exclusive venue for disputes will be the state or federal courts in Birmingham, Alabama.

15. Termination

These Terms remain effective until terminated.

You may terminate them by stopping use of the Site. If you are dissatisfied with the Site, Content, or Terms, your sole remedy is to stop using the Site.

16. General

If any provision is invalid or unenforceable, it will be applied as closely as permitted to the parties’ intent, and the remaining provisions remain effective. ExpectCare’s failure to enforce a provision is not a waiver. Alabama law governs these Terms, without regard to conflict-of-law rules. These Terms and the Privacy Practices constitute the entire agreement concerning the Site and supersede prior understandings on that subject.
